Apex — Training & Nutrition

Terms of Use

Last updated: August 19, 2026

These Terms of Use (the "Terms") are the agreement between you and Mohsin Ajmal, the independent developer of Apex ("we", "us"), covering your use of the Apex iOS application ("Apex" or the "App"). Please read them before you use the App. By downloading, installing, or using Apex, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Two things worth reading first.

Apex is not medical advice. It gives you fitness and nutrition information, including AI-generated workout plans and calorie targets. No doctor, dietitian, or trainer reviews what it produces. See section 3.

Apex Pro is an auto-renewing subscription billed by Apple. It renews until you cancel it in your App Store settings. See section 5.

1. Acceptance and eligibility

By accessing or using Apex you agree to these Terms, and to Apple's App Store Terms of Service, which govern your download of the App and any purchase you make through it.

You must be at least 16 years old to use Apex. The App handles health information and produces AI-generated training loads and calorie targets, which is not appropriate for younger users. If you are under 16, do not use the App. If you are between 16 and the age of majority where you live, you may use Apex only with the consent and supervision of a parent or guardian who accepts these Terms on your behalf.

2. What Apex is

Apex is a personal training and nutrition app for iPhone. It builds personalized workout and meal plans, logs your workouts, meals, and weight, analyses photos of your food to estimate its nutrition, offers an AI coach chat, tracks streaks, milestones, and recovery days, and charts your progress over time.

Apex is local-first. There is no account, no login, and no server of ours holding your training history. Your data lives in a database on your iPhone. The narrow, specific cases in which information leaves your device are described in our Privacy Policy.

3. Health and safety — this is not medical advice

Apex provides fitness and nutrition information for general educational purposes only. It is not medical advice, it is not a medical device, and it is not a substitute for professional care. Nothing in the App is reviewed by a physician, registered dietitian, physiotherapist, or certified trainer before you see it.

Consult a qualified healthcare professional before starting any exercise or nutrition programme, and particularly before using Apex if you:

  • have a current or past injury, or any chronic pain
  • have a heart, respiratory, metabolic, or musculoskeletal condition
  • are pregnant, postpartum, or breastfeeding
  • have a history of an eating disorder or disordered eating
  • take medication that affects your heart rate, blood sugar, blood pressure, or appetite
  • are recovering from surgery or an illness

Exercise carries an inherent risk of injury, and dietary change carries risk too. You use Apex at your own risk and you are solely responsible for your own safety. Stop exercising and seek medical attention immediately if you feel chest pain, dizziness, faintness, breathlessness beyond normal exertion, or sharp or unusual pain. Use loads, ranges of motion, and progressions that are appropriate for you — the App cannot see your form, your fatigue, or your environment.

Apex includes safeguards such as minimum calorie floors and automatic deload weeks. These are crude, generic guardrails built into software. They are not medical supervision and must not be treated as clearance to train or to eat at a given intake. Calorie and macro targets are estimates derived from formulas and from the details you enter; your actual needs may differ substantially.

4. AI-generated content

Several Apex features — plan generation and regeneration, coach chat, meal-photo analysis, and weekly insights — are produced by a third-party AI model (Google's Gemini API). You should understand what that means:

  • Outputs can be wrong. AI models can produce information that is inaccurate, incomplete, outdated, or internally inconsistent, stated with complete confidence.
  • Photo-based nutrition estimates are approximations. Estimating calories and macros from an image cannot account for hidden oils, portion weight, preparation method, or ingredients you cannot see. Treat the numbers as rough guidance, not measurement. Weigh and read labels when accuracy matters.
  • The coach is not a person. The chat is software. It has no clinical training, cannot examine you, and cannot handle an emergency.
  • You are responsible for verifying anything health-critical before acting on it, with a qualified professional where appropriate.

When AI is unavailable, Apex falls back to deterministic on-device logic so the App keeps working. Those fallback outputs carry the same disclaimers.

5. Free preview, subscriptions, and billing

14-day Pro Preview. Every new install gets full access to all Pro features for 14 days. No payment details, no signup, nothing to cancel. When the preview ends, the App continues to work with the free features described in section 6.

Apex Pro subscriptions. Continued access to Pro features is sold as an auto-renewable subscription in one subscription group, in these options:

  • Monthly — US$9.99 per month, including a 1-week free trial for new subscribers.
  • Annual — US$71.88 per year (about US$5.99 per month), including a 1-week free trial for new subscribers.

Prices shown here are for the United States storefront. Apple sets and localizes prices for each country, and the App always displays the live App Store price and currency that applies to you. Free trials are available to new subscribers only and are subject to Apple's eligibility rules. There is no lifetime or one-time purchase option.

How billing works. All purchases are processed by Apple, not by us:

  • Payment is charged to your Apple Account at confirmation of purchase, or at the end of any free trial.
  • Your subscription renews automatically at the then-current price for the same period, unless you cancel it.
  • Your Apple Account is charged for renewal within 24 hours before the end of the current period.
  • A free trial converts into a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited if you buy a subscription during the trial.
  • To cancel, go to Settings → your Apple Account → Subscriptions on your device (or manage subscriptions in the App Store app) and turn off auto-renewal at least 24 hours before the period ends. You keep Pro access until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

Refunds. We cannot issue refunds, because we never receive your payment. Refunds are handled entirely by Apple under its standard App Store policy, and you can request one at reportaproblem.apple.com. Apple decides those requests. We do not offer a money-back guarantee; the free trial and the 14-day in-app preview are how you evaluate Apex before paying.

Price changes. We may change subscription prices. Where a change affects your existing subscription, Apple will notify you and, where required, ask for your consent before the new price takes effect; if you do not agree, your subscription will not renew at the higher price. Price changes never apply retroactively to a period you have already paid for.

6. Free features and Pro features

After your 14-day preview, Apex keeps working without a subscription. The essentials stay free: unlimited workout logging and unlimited manual and barcode meal logging.

Apex Pro currently unlocks AI meal-photo scanning, plan regeneration, unrestricted AI coach chat (the free tier includes a small lifetime allowance of messages), your full analytics history, and body-composition trends.

We may change which features sit on each side of that line, and the specific limits within the free tier, as the App develops. We will not remove a feature from an active paid subscription period you have already paid for without offering you a remedy.

7. Your licence to use Apex

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Apex for your own personal, non-commercial fitness use, on Apple devices that you own or control, as permitted by the App Store Terms of Service.

You agree not to:

  • reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by law
  • extract, scrape, copy, or redistribute the exercise video library, imagery, food and nutrition database, or generated plans, whether by hand or by automated means
  • use Apex, or content it generates, to build, train, or improve a competing product or any machine-learning model
  • resell, sublicense, rent, or commercially exploit the App or any Pro entitlement, or use it to provide coaching services to others
  • circumvent or tamper with the subscription, entitlement, or trial mechanisms, or access Pro features without a valid entitlement
  • use the App unlawfully, or in a way that interferes with the App or with any third-party service it depends on

8. Ownership and licensed content

Apex, including its software, design, the "cc" design system, text, icons, and artwork, belongs to us and is protected by copyright, trademark, and other laws. The Apex name and logo are our trademarks. Rights not expressly granted in these Terms are reserved.

Exercise media is licensed, not ours to give away. The exercise videos and imagery in the App are licensed from a third-party library (MoveKit) for use inside Apex only. You receive no right to download, extract, republish, or redistribute that media, and no right to use it outside the App.

Workout and meal plans that Apex generates for you are yours to follow, personally and non-commercially. You may not sell them, publish them as a product, or use them to deliver paid coaching or programming to other people.

9. What you put into Apex

You keep ownership of everything you enter: your profile, logs, weights, notes, coach chat messages, and meal photos. We claim no ownership of it, and because Apex has no accounts and no server of ours, we cannot read it.

You are responsible for what you choose to submit to the AI features. When you use them, the relevant context — which can include your profile details, recent training and nutrition history, your free-text recovery notes, your chat messages, and the food photo you took — is sent from your device to Google's Gemini API so it can generate a response. Do not enter anything you would not want processed by a third-party AI service, including sensitive clinical details, other people's personal information, or identifying information you would rather keep to yourself. The Privacy Policy sets out exactly what is sent, and when.

You agree not to use the AI features to attempt to generate unlawful, abusive, or harmful content, or to solicit medical diagnosis or treatment.

10. Your data, and deleting it

Because Apex has no account system, there is no data for us to hand over or delete on your behalf, and no export or account-recovery service we can offer. Deleting Apex from your iPhone deletes the App's data with it, permanently and irreversibly. There is no backup on our side, so if you delete the App, or lose or reset your device, your training history is gone unless it was included in your own iCloud or computer backup.

Anything Apex wrote to Apple Health stays in Apple Health, under your control, and is managed in the Health app. Purchase records held by Apple and by our subscription provider are not deleted by removing the App, because they are billing records rather than App data.

11. Third-party services

Apex depends on services we do not control: Apple (the App Store, purchases, and Apple Health), Google (the Gemini API that powers the AI features), and RevenueCat (which validates purchases and manages subscription entitlements).

Your use of those services is subject to their own terms and privacy policies. We are not responsible for their availability, accuracy, or acts, and interruptions to them may temporarily degrade or disable parts of the App — AI features in particular. We may change or replace a provider as the App develops.

12. Availability and changes to the App

We may modify, update, suspend, or discontinue Apex or any of its features at any time, and we may stop supporting older versions of iOS or of the App. We do not promise that the App will always be available, or that it will run on future devices or operating system versions.

13. Disclaimer of warranties

To the fullest extent permitted by law, Apex is provided "as is" and "as available", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, secure, or error-free; that its plans, calorie targets, macro targets, nutrition estimates, or AI outputs are accurate, complete, or suitable for you; or that using it will produce any particular fitness, weight, body composition, or health outcome. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived by agreement.

14. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of Apex — including any injury, health consequence, or outcome resulting from following a workout plan, a calorie or macro target, a nutrition estimate, or any AI-generated guidance, and including any loss of your locally stored data.

Our total aggregate liability for all claims relating to Apex is limited to the greater of the amount you actually paid us for the App in the 12 months before the claim arose, or US$50. These limits apply even if we have been advised of the possibility of such damages, and they do not apply to liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or under mandatory consumer protection law where you live.

15. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, your use of the App in a way that is unsafe for you or others, or content you submit through the App.

16. Apple

These Terms are between you and us only. Apple is not a party to them and has no obligation to you in respect of Apex. Specifically:

  • We, not Apple, are solely responsible for Apex, its content, and any maintenance or support for it. Apple has no obligation to provide support for Apex.
  • If Apex fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for Apex, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claim by you or a third party relating to Apex or your use of it, including product liability claims, claims that Apex fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
  • We, not Apple, are responsible for investigating and defending any third-party claim that Apex or your use of it infringes that party's intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them directly against you.

17. Termination

You may end this agreement at any time by cancelling any subscription in your App Store settings and deleting Apex from your device. We may suspend or terminate your licence if you materially breach these Terms — for example by tampering with entitlements or extracting licensed content. Sections that by their nature should survive termination do so, including ownership, disclaimers, limitation of liability, and indemnity.

18. Governing law

These Terms are governed by the laws applicable in the developer's jurisdiction, without regard to conflict-of-law principles, and any dispute arising under them will be brought in the courts of that jurisdiction. Nothing in this section removes the protection of mandatory consumer law in your country of residence, or your right to bring proceedings there where that law gives you it.

19. Changes to these Terms

We may revise these Terms as the App changes or as the law requires. The current version is always the one on this page, and the "last updated" date at the top tells you when it changed. For material changes we will give notice in the App where practical. Continuing to use Apex after a change takes effect means you accept the revised Terms; if you do not accept them, stop using the App and cancel any subscription.

20. Contact

Questions about these Terms, or about Apex, go to mohsin@dnadeveloper.com. For a billing or refund issue, contact Apple first — they hold the transaction.
